Ecolopark and Ecolopark Plus Parking Lot Terms of Use
When using the hourly parking facilities “Ecolopark” and “Ecolopark Plus” (hereinafter collectively referred to as “the Parking Facilities”) managed or operated by Ecolo City Co., Ltd. (hereinafter referred to as “the Company”), users must comply with the provisions of these Terms and Conditions.
However, if there are individual rules or posted notices at each parking lot that differ from these Terms and Conditions, the content of such posted notices shall take precedence.
Provision of Parking Spaces
The purpose of the Parking Facilities is to provide paid spaces for short-term parking (at the rates posted within the facilities) and is not intended for the storage or management of vehicles. Furthermore, the premises may not be used for any purpose other than parking automobiles. Additionally, conducting business activities within the parking facilities without the Company’s written consent is prohibited.
Parking Duration
The maximum parking duration shall be 48 hours from the time of entry (hereinafter referred to as the “Maximum Parking Duration”). Continuous parking exceeding 48 hours is not permitted. However, this restriction does not apply if prior consent has been obtained from the Company or if a different time limit is posted within the parking lot.
Disclaimer
The Company shall not be liable for any theft, loss, or damage to vehicles, their accessories, attachments, or cargo within the parking lot, except where such loss or damage is attributable to the Company’s fault. Furthermore, the Company shall not be liable for any damages incurred by users of this parking lot due to the actions of other users or other persons, or due to vehicles, their accessories, or cargo present within the parking lot, or for any damages incurred within this parking lot arising from causes not attributable to the Company, including the following damages:
- Theft, loss, or damage to vehicles or their cargo within the parking lot
- Injury, accident, or damage to vehicles or other property within the parking lot
- Damage to the vehicle body, etc., caused by failure to check the condition of the parking space during entry or exit
- Damage caused by the user pressing the wrong parking space button or operating errors after payment
- Damage to vehicles modified (e.g., muffler replacement) during use
- Damage to vehicles equipped with aero parts (including standard equipment) during use
- Damage caused by natural disasters, other reasons beyond our control, or force majeure (e.g., power outages)
- Compensation for waiting time until staff arrival
Vehicles Permitted for Parking
Only vehicles meeting the following criteria may be parked in this parking lot. Parking of any other vehicles is prohibited. However, some parking lots or spaces may have additional criteria beyond those listed below; in such cases, the on-site signage takes precedence.
- Vehicles permitted for parking must meet the following dimensions: -Overall length: 5.0m or less – Overall width: 1.9m or less – Overall height: 2.1m or less – Weight: 2.5 tons or less – Minimum ground clearance: 15cm
(Compact cars: length ≤ 4.7m, width ≤ 1.7m; Light vehicles: length ≤ 3.4m, width ≤ 1.5m) However, if separate on-site signage within the parking lot differs from the above, that signage takes precedence. - Even vehicles meeting the criteria in 1 cannot park if they fall under the following categories:
- Vehicles with a minimum ground clearance exceeding 25 cm, or vehicles whose shape may cause the vehicle entry recognition system to malfunction.
- Vehicles equipped with auto-leveling functions or similar features that cause the vehicle height to change.
- Vehicles with aerodynamic parts or other features that may cause entry/exit problems by contacting the locking plate.
- Vehicles prohibited from driving on public roads, such as unregistered vehicles or vehicles with expired inspections.
- Vehicles where the license plate is covered or removed, making it difficult for the automatic license plate recognition system to read.
- Vehicles with changes to their registration details that have not undergone the required change registration procedures.
- Vehicles where identification is difficult, such as those with temporary registration.
- Vehicles with attached accessories, etc., that may cause damage to parking facilities, equipment, or other vehicles upon contact.
- Vehicles for special purposes, such as large special-purpose vehicles or construction special-purpose vehicles, that may damage parking facilities or equipment.
- Vehicles carrying dangerous goods, harmful pollutants, or other items that may compromise safety or hygiene, or items that cause foul odors or fluid leaks.
- Notwithstanding the above, parking (use) by members or associates of organized crime groups, organized crime-related groups, or other antisocial organizations is strictly prohibited.
- In addition to vehicles not meeting the criteria in 1 and 2, motorcycles, mopeds, bicycles, and small special-purpose vehicles are not permitted to park. However, this restriction does not apply if the parking lot specifically displays signage permitting such parking.
Parking Fees
- Users must pay parking fees according to the posted rates and fee structure, based on the duration of parking.
- Parking time shall be as follows:
- For lock-type or sensor-type parking spaces without lock plates: The time from entering the parking space detected by the sensor until exiting.
- For gate-type, mechanical, or tower-type parking facilities: The time from ticket issuance upon entering the parking facility to ticket collection upon exiting.
- For license plate recognition, the time from entry into the detected parking space to exit, as recorded by the authentication camera
- Parking fees must be paid using the methods designated for each parking lot, such as the payment machines or payment terminals provided within the parking lot, or via online payment using a smartphone or similar device.
- Regardless of whether a lock plate, gate, or flapless system is present, please follow the designated payment procedures posted within each parking lot.
- At payment machines accepting cash, high-denomination bills such as ¥10,000, ¥5,000, or ¥2,000 cannot be used. Please prepare ¥1,000 bills or coins in advance for payment. (Some machines accept high-denomination bills).
- If you lose your parking ticket, you must pay a parking fee (up to ¥30,000) to exit. The specific amount varies by parking lot. Furthermore, if we confirm you have exceeded the maximum parking time and the parking fee exceeds the above amount, you must pay the full parking fee.
- Exit promptly after payment. Please note that if you do not exit completely, you may be charged continuously.
Parking Method
- Users must park correctly within the center of the designated parking space lines. Please refrain from parking outside the designated parking space.
- When parking or stopping within the parking lot, apply the parking brake and promptly turn off the engine. However, this does not apply if we have separately approved otherwise.
- Do not park in spaces blocked by traffic cones or tape. We assume no responsibility for any vehicle damage occurring while parked in a blocked space.
- Do not park in spaces blocked off by traffic cones, tape, or similar barriers. We assume no responsibility whatsoever for any damage to vehicles parked in such blocked-off spaces.
In Cases of No Change Available or Failure to Issue Receipts
- If a receipt cannot be issued due to machine malfunction, please contact the emergency contact number posted on-site. A receipt will be issued at a later date.
- If payment is made when change is unavailable, the machine may issue a “receipt slip” instead of providing change. If a receipt slip is issued, or if a refund is required due to machine malfunction, we will issue a refund at a later date. Please contact the emergency contact number posted on-site.
Prohibited Acts and Other Restrictions
- No Drunk Driving
Driving under the influence (including drugs) is prohibited. - Obligation to Drive Safely
When driving within the facility, proceed at a speed of 4 km/h or less and exercise extreme caution around other vehicles and pedestrians. - Prohibition of Disturbing Behavior
Do not idle engines, rev engines, play loud audio, slam doors, engage in loud conversations at night, or sleep in vehicles within the premises. Smoking is prohibited on the premises. - Prohibition of Unsanitary Acts
Leaving trash (cigarette butts, empty cans, lunch boxes, magazines) on the premises, urinating in public, and other unsanitary acts are strictly prohibited. - Priority for Exiting Vehicles; No Waiting to Enter
This parking lot prioritizes exiting vehicles. Do not wait to enter near the entrance or along the roadside. This causes trouble. - No Parking in Driveway Areas
If you enter the parking lot with the “Vacant” display due to equipment malfunction and no spaces are available, do not park in the driveway. Please exit promptly. - Reversing After Obtaining Parking Ticket or After Payment
Do not reverse your vehicle after obtaining a ticket upon entry or after paying the fee upon exit. Reversing to turn around, retrieve change, or retrieve a receipt will cause the gate bar to descend. - Handling Precautions for Parking Tickets
Handle parking tickets and passes with care. Do not bend them or expose them to magnets. Doing so may prevent entry or exit. - No Parking in Monthly Spaces
Spaces marked as monthly parking on the pavement or by signs are reserved exclusively for monthly contract holders. General use vehicles are not permitted to park there. - Safety Precautions When Walking
Walking under gate bars is extremely dangerous. Absolutely do not do this. - Prohibition of Unnecessary Actions Regarding Equipment and Facilities
Parking lot users and their associates (including passengers) must not park or enter prohibited areas, nor touch equipment or facilities except for necessary payment operations. - Obligation to Report Damage to Equipment or Facilities
If you damage any equipment or facilities, please immediately contact the emergency contact number posted within the premises. - Obligation to Contact in Case of Trouble
If a problem occurs, please confirm the terms and conditions and contact the emergency contact number. The company shall not be liable for any damage to vehicles caused by users forcing entry or exit based on their own judgment. The company shall not be liable for damages resulting from waiting times during exit due to reasons not attributable to the company. - Compliance with On-Site Signs and Posters
Please comply with the contents stated on the warning signs and notices within the premises. - Prevention of Customer Harassment
Making unreasonable demands against our company or engaging in socially unacceptable behavior is prohibited.
This includes assault, injury, threats, slander, defamation, insults, abusive language, privacy violations, excessive demands without legitimate reason, or prolonged detention due to persistent complaints.
Illegal Parking
If a user fails to pay parking fees, removes a vehicle from a parking space, moves it outside the parking lot, parks in a location other than a designated parking space, or parks in a manner prohibited by our terms and conditions as an illegal act, that user shall pay the Company ¥50,000 as damages in addition to the unpaid parking fees. Furthermore, the Company may prohibit such users from using this parking lot and other parking lots managed by the Company in the future.
Handling of Abandoned Vehicles
- If a user parks a vehicle for more than 48 hours without notifying us, we may request the vehicle’s retrieval by a deadline specified by us via notices posted within the parking lot or other means.
- In the case described in the preceding paragraph, if the user refuses to retrieve the vehicle, is unable to retrieve it, or if the user cannot be identified without fault on the part of the Company, the Company may notify the vehicle owner, etc. (meaning the owner and user listed on the vehicle inspection certificate; the same applies hereinafter) or request retrieval by a specified deadline via notice. In this case, the user shall be deemed to have relinquished all rights upon the vehicle’s handover to the owner or other relevant party and shall not raise any claims for handover or other objections against us.
- If the vehicle is not retrieved by the specified deadline despite the requests made in the preceding paragraphs, the Company may deem the owner or user to have refused retrieval.
- After the date specified under Paragraph 1 has passed, the Company shall not be liable for any damages incurred to the vehicle, except those caused by the Company’s intentional act or gross negligence.
- In the case of Paragraph 1, the Company may inspect the vehicle (including its interior) to the extent necessary to identify the user or owner.
- In the case described in Paragraph 1, if management becomes difficult, the Company may move the vehicle to another location after giving prior notice by posting a notice.
- If the owner or other party refuses to retrieve the vehicle, is unable to retrieve it, or if the Company cannot ascertain the owner or other party without fault on its part, and retrieval does not occur within the specified period despite notification or posting of a demand, the Company may, after three months have passed from the date of the demand and after further notification, sell, dispose of, or otherwise handle the vehicle.
User Liability for Damages
If a user violates these Terms and Conditions or any regulations posted within the parking lot, or intentionally or negligently damages the parking lot’s facilities or equipment, such user shall compensate the Company for all damages incurred as a result, in addition to the usage fee. Such damages shall include investigation costs, notification costs, vehicle relocation costs, removal costs, attorney fees, and other incidental expenses incurred in addressing the violation or unauthorized use. Furthermore, if the Company is forced to suspend operations of the entire parking lot or part thereof as a result, the loss of business profits arising therefrom shall also be included.
Handling of Image and Video Information
Images and video footage captured by video cameras or similar devices within and around the parking lot shall be used solely for the purposes of parking lot operation and management, ensuring safety, preventing unauthorized parking, and cooperating with police and other authorities for crime prevention and investigation. Furthermore, such captured images and video footage shall not be disclosed or provided to the user or any third party, except when deemed necessary by the Company based on the aforementioned purposes or when required by law to disclose or provide such information.
Changes to These Terms and Conditions
The Company may amend these Terms and Conditions and the individual regulations of the parking lot without requiring prior approval from users. The amended content shall take effect upon notification through posting on the Company’s website or other methods deemed appropriate by the Company.
In such cases, the amended terms shall take effect on the effective date posted on our website or the effective date explicitly stated in the appropriate notification method used by the Company.
